Final MLR Rules Announced
As reported in our January 2011 newsletter, the new medical loss ratio (MLR) rules will have an adverse impact on brokers' fees. Brokers have lobbied hard to have their fees exempted from the calculation of administrative costs under the new MLR rules, but their efforts were rebuffed under recently issued rules from the Department of Health and Human Services (HHS). A positive note in the final rules provides that any rebates must be in the form of lower premiums or other ways that are tax-free. "Kaiser Health News"
Updates from DOL/EBSA
The US Department of Labor's Employee Benefits Security Agency (EBSA) has created a new consumer assistance web page that provides access to useful information and allows users to submit questions and complaints about health and retirement plans electronically.

The DOL, HHS (Department of Health and Human Services), and IRS have jointly issued a new set of FAQs (Part VII) addressing health care reform's new Summary of Benefits and Coverage (SBC) requirements and mental health parity (MHPAEA) implementation.

Attention Walmart Patients
Walmart, the nation's largest retailer and private employer, is planning to dominate a wide range of medical services. According to Kaiser Health News, Walmart has submitted an RFI to vendors of wellness, preventative, diagnostic, and acute care services, such as digestive and urinary exams, and providers that manage chronic diseases like diabetes, asthma, COPD, heart disease, arthritis, sleep apnea, kidney disease, depression, and AIDs.
